  4. If you would like to receive Oracle Support for your Oracle7 ODBC 
  5. Driver, please call (415) 506-1500 in the US, or contact your local 
  6. Oracle Sales office. Please note that Oracle will not provide support 
  7. on the Oracle7 ODBC Driver unless a Support License Contract is in 
  8. place. If you prefer to receive an actual production kit from Oracle, 
  9. please call 1-800-542-1170 in the US, or contact your local Oracle 
  10. Sales office.

  13. IMPORTANT--READ THE FOLLOWING LICENSE AGREEMENT CAREFULLY BEFORE 
  14. INSTALLING AND/OR USING THE PROGRAM.  
  15.  
  16. By installing and/or using the Program, you indicate your acceptance of
  17. the following Oracle Program License Agreement ("Agreement").  If you 
  18. do not agree to the terms of this Agreement, promptly delete the 
  19. Program from your computer and cease use of the Program. 
  20.  
  21. Oracle Corporation ("Oracle") grants you ("Customer") a license to use 
  22. the Oracle7 ODBC Driver software ("Program") as indicated below. 
  23.  
  24. Customer may make and use an unlimited number of copies of the Program 
  25. solely for Customer's internal data processing operations; provided that:
  26. (a) the Program is not modified in any way; and (b) Customer maintains 
  27. the copyright notice on all copies of the Program.  Customer may not 
  28. use the Program for commercial timesharing, rental, or service bureau 
  29. use. The Program may not be transferred, sold, assigned, or otherwise 
  30. conveyed to another party without Oracle's prior written consent.  
  31. Customer agrees not to cause or permit the reverse engineering, 
  32. disassembly, or decompilation of the Program.  Customer shall not 
  33. disclose the results of any benchmark tests of the Programs to any 
  34. third party without Oracle's prior written approval.

  36. Customer acquires only the right to use the Program and does not 
  37. acquire any rights of ownership in the Program.  Oracle, or its 
  38. licensor, shall at all times retain all rights, title and interest in 
  39. the Program. 
  40.  
  41. Oracle may terminate this Agreement if Customer breaches any of its 
  42. terms.  Upon termination, Customer shall cease using the Program and 
  43. shall destroy or return to Oracle all copies of the Program including 
  44. all modifications and merged portions in any form. 
  45.  
  46. This Agreement is governed by the laws of the State of California.   
  47.  
  48. ORACLE DOES NOT WARRANT THE PROGRAM AND ORACLE DISCLAIMS ALL WARRANTIES, 
  49. EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED 
  50. WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND 
  51. NONINFRINGEMENT;  THIS PROGRAM IS DISTRIBUTED "AS-IS".  ORACLE SHALL 
  52. NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL 
  53. DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA OR DATA USE, 
  54. INCURRED BY CUSTOMER OR ANY THIRD PARTY, WHETHER IN AN ACTION IN 
  55. CONTRACT OR TORT, EVEN IF CUSTOMER OR ANY OTHER PERSON HAS BEEN ADVISED 
  56. OF THE POSSIBILITY OF SUCH DAMAGES.  ORACLE'S LIABILITY FOR DAMAGES 
  57. HEREUNDER SHALL IN NO EVENT EXCEED THE FEES PAID BY CUSTOMER UNDER THIS 
  58. AGREEMENT.

  60. Customer agrees to comply fully with all relevant export laws and 
  61. regulations of the U.S. to assure that neither the Programs, nor any 
  62. direct product thereof, are exported, directly or indirectly, in 
  63. violation of U.S. law.  The Program may not be transferred outside the 
  64. country where delivery is taken or transferred, sold, assigned, or 
  65. otherwise conveyed to another party without Oracle's prior written 
  66. consent.

  68. If the Program is delivered to a U.S. Government Agency of the 
  69. Department of Defense, then it is delivered with Restricted Rights and 
  70. the following legend is applicable.

  73. Use, duplication or disclosure by the Government is subject to 
  74. restrictions as currently set forth in subparagraph (c)(1)(ii) of DFARS 
  75. 252-227-7013, Rights in Technical Data and Computer Software

  79. If the Program is delivered to a U.S. Government Agency not within the 
  80. Department of Defense, then it is delivered with "Restricted Rights" as 
  81. defined in FAR 52.227-14,  Rights in Data - General, including 
  82. Alternate III (June 1987).

  84. Unless both parties have signed a license agreement covering the 
  85. Program, this Agreement constitutes the complete agreement between the 
  86. parties and supersedes all prior or contemporaneous agreements or 
  87. representations, written or oral, concerning the subject matter of this 
  88. Agreement.  This Agreement may not be modified or amended except in a 
  89. writing signed by a duly authorized representative of each party; no 
  90. other act, document, usage or custom shall be deemed to amend or modify 
  91. this Agreement.  The waiver by either party of any breach of this 
  92. Agreement shall not constitute a waiver of any other or subsequent 
  93. breach.
